    内容提要
    《世界贸易组织体制下的中国教育服务开放研究》从分析教育的性质入手,研究教育的功能和政府在提供教育服务方面的责任和义务,分析教育产业化的必要性和可能性。教育的产业化并不减少或削弱政府的教育职责;相反,教育的产业化要求加强政府的教育职责,它只是为政府实现教育目标提供了新的选择。教育的经济属性使得教育服务可以跨境提供,实现部分教育部门(主要是高等教育服务)的国际化。开放教育服务是我国加入世界贸易组织(WTO)的庄严承诺。但是,我国学者很少研究“入世”以后教育服务开放面临的法律环境。国内教育立法的不完善与开放教育服务过程中出现的种种问题对我国履行“人世”承诺产生较大的影响。因此,从法律角度研究WTO体制下的中国教育服务开放政策具有理论和现实意义。《世界贸易组织体制下的中国教育服务开放研究》认为,教育在本质上是一种服务,属于准公共产品,具有政治、经济、文化和社会功能。国内的学术界、教育界、政府部门片面强调教育的政治、文化和社会属性,对教育的经济属性认识不足。学术界和普通民众对教育产业属性的认识甚至发生偏差,简单地把教育高收费和乱收费等同于教育产业化。
